1. Who you are contracting with

KerbGrub (kerbgrub.com) is a business based in the United Kingdom ("we", "us", "our"). By using KerbGrub you enter into an agreement with KerbGrub.

2. Acceptance of these terms

By browsing KerbGrub, creating a trader account or buying any paid feature you agree to these terms. If you do not agree, please stop using the site. Continued use after we update these terms means you accept the updated version.

3. What KerbGrub is — and what we sell

KerbGrub is a software-as-a-service directory that lets mobile food traders publish their pitch, menu and opening times, optionally broadcast a live GPS position, and lets the public find them. Public use of the site is free.

The only products sold on this website are digital subscriptions and digital listing upgrades supplied to traders: the Pro subscription, the seven-day featured boost and the event page. These are delivered electronically and take effect in the trader dashboard immediately after payment.

No food, drink or other physical goods are sold, ordered, paid for or delivered through KerbGrub. We are not a party to any sale between a trader and their customers, we do not take or hold payment on their behalf, we do not process orders, and we do not prepare or deliver food. Customers buy directly from the trader in person.

4. Your account

You must be at least 18 and, if you sign up for a business, have authority to bind that business. You are responsible for keeping your sign-in details confidential and for everything done under your account. Information you publish — van name, pitch, menu, prices and hours — must be accurate and kept up to date.

5. Acceptable use

You must not:

• use KerbGrub for anything unlawful, fraudulent or misleading;
• post spam, or list a van, menu or pitch you do not operate;
• infringe anyone's intellectual property or privacy;
• interfere with the security of the service — no malware, probing, scraping or circumventing technical limits;
• reverse engineer, resell or redistribute the service.

6. Live location

Live GPS tracking is optional and only runs while you switch it on in your dashboard. While it is on, your device's position is published on the public site until you switch it off. Do not switch it on for a vehicle you are not operating, and do not use the dashboard while driving.

7. Intellectual property

We own the KerbGrub software, branding and site content. You keep ownership of the content you upload and grant us a non-exclusive licence to host, display and share it so we can run the service and promote listings. We grant you a limited, non-exclusive, non-transferable right to use KerbGrub in line with the plan you choose.

8. Paid features, billing and taxes

Paid features (Pro subscriptions, boosts and event pages) are described with current prices on our pricing page. Subscriptions renew automatically at the interval you select until you cancel, and you can cancel at any time from your dashboard.

Payments are processed securely by Stripe on our behalf. Card details are entered directly with Stripe and are never seen or stored by KerbGrub. Billing questions and refund requests are handled by us at hello@kerbgrub.com.

9. Service availability

We work to keep KerbGrub available, but we do not guarantee uninterrupted or error-free performance. Features may change, and maintenance or third-party outages may interrupt the service. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Liability

Our aggregate liability to you is limited to the fees you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost profits, lost sales, lost data or goodwill. Nothing here excludes liability for fraud, death or personal injury caused by negligence, or anything else that cannot be excluded by law.

11. Indemnity

You will indemnify us against claims arising from the content you publish, your unlawful use of the service, or your breach of these terms.

12. Suspension and termination

We may suspend or close an account for material breach of these terms, non-payment, fraud or security risk, or repeated policy violations. You may close your account at any time. When access ends your listing is removed from the public site; contact us within 30 days if you need a copy of your data.

13. Assignment and force majeure

You may not transfer your account without our consent. We may transfer this agreement as part of a merger, acquisition or sale of the business. Neither party is liable for delays caused by events beyond their reasonable control.

14. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
